Tree Removal and Tree Service in Oakland

Oakland's protected tree ordinance reaches further into private yards than most. A coast live oak is protected from 4 inches in trunk diameter and nearly every other tree from 9 inches, front yard or back, and removing one requires a city permit.

Which Oakland trees need a removal permit?

Any protected tree. Chapter 12.36 defines that as a coast live oak of 4 inches or more in diameter at breast height, or any other tree of 9 inches or more, with eucalyptus and Monterey pine left out. Every tree in the public right-of-way is protected at any size.

Backyards count
The city states that the non-development permit applies to removals on private property, front and back yards included.
Eucalyptus and Monterey pine
Not protected on an ordinary private lot. Monterey pines are protected on city property and in some larger development cases.
Building projects
Removal tied to a design review, building, grading or demolition permit goes through the separate development-related tree permit.

The non-development tree permit

A homeowner who wants a protected tree out for reasons unrelated to construction applies for a non-development tree removal permit through the city's Online Permit Center. Tree Services, part of Oakland Public Works, inspects the tree and handles the posting and notice that the ordinance requires.

The application terms are published by the city. Check the current requirements before applying, because the city revises it.

Penalties for skipping the permit can be severe. In 2025 a City Council committee took up a case in which a couple had been assessed a very large penalty for removing 38 protected trees without permits.

What the 1991 firestorm changed in the hills

On October 20, 1991 a grass fire in the hills above the Caldecott Tunnel was driven downslope by hot, dry Diablo winds. It killed 25 people and destroyed about 3,000 homes in Oakland and Berkeley in a matter of hours. Dense stands of eucalyptus and pine, planted a century earlier, carried the fire from crown to crown.

Since then the Oakland Fire Department has inspected hill properties each year for vegetation clearance. Owners are expected to limb trees up from the ground, clear dead wood and keep canopies away from roofs and chimneys.

This is why eucalyptus and Monterey pine sit outside the protected tree definition. Thinning or removing them on a private hill lot is usually a fire safety job, not a permit question.

Oak and pine problems to watch in the East Bay

  • Dark, sticky bleeding on a coast live oak trunk

A possible sign of sudden oak death, which is established in the East Bay hills. Have it tested before deciding.

  • An oak whose whole crown browns within a few weeks

Late-stage infection. The wood decays fast and the tree becomes unsafe to climb.

  • A Monterey pine with a thin top and dead lower limbs

These pines are near the end of their lifespan here and break in winter wind.

  • Eucalyptus bark and leaves piling against a fence or deck

Fuel. The annual inspection will flag it.

  • A tree on a slope with soil pulling away uphill

The ground is moving with the roots. Treat this as urgent in a wet winter.

How a permitted removal runs

  1. Measure and identify

Diameter is taken 4.5 feet above the ground. Species decides whether the 4-inch or 9-inch line applies.

  2. Apply online

The owner selects the non-development tree permit in the Online Permit Center and completes the application.

  3. City inspection and notice

Tree Services reviews the tree and posts notice. Work waits until the permit is actually issued.

  4. Removal

On hill lots this often means a crane on the street or a climber lowering pieces down the slope by rope.

  5. Replacement

Approval may come with a condition to plant a replacement tree.

Oakland tree permit questions

Do I need a permit to remove a eucalyptus in Oakland?

Generally not on a private lot, because eucalyptus is excluded from the protected tree definition. A eucalyptus in the street right-of-way is a city tree and is protected.

How small can a protected oak be in Oakland?

A coast live oak is protected once its trunk reaches 4 inches in diameter at 4.5 feet above the ground. That is a young tree, often less than 15 feet tall.

Can I prune a protected tree without a permit?

Ordinary pruning that does not harm the tree is treated differently from removal, but severe cutting that kills or disfigures a protected tree can be enforced as a removal. Ask Tree Services before heavy work.

Does the fire inspection let me remove a protected oak?

No. Clearance means pruning and removing dead material. Taking out a protected oak still needs the tree permit.
